Because Unburn is operated as a sole proprietorship rather than a company, the proprietor named above enters into these Terms in his personal capacity as the operator of the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have the involvement of a parent or guardian who agrees to be bound by these Terms on your behalf. By using the Service you represent and warrant that you meet these requirements.
3. What Unburn is (and is not)
Unburn is a consumer wellbeing application that helps you understand and reduce burnout risk through self-tracking, validated stress questionnaires (PSS-4 and PSS-10), gentle reminders and calendar-aware scheduling.
Unburn is not a medical device. It does not diagnose, treat, cure or prevent any illness and it is not a substitute for professional medical advice. See our Wellbeing disclaimer for details, and always consult a qualified healthcare professional if you are concerned about your health.
4. Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on any Apple-branded device that you own or control, for your own personal, non-commercial use, subject to these Terms and Apple’s Media Services Terms and Conditions.
You must not:
- copy, modify, adapt, translate, reverse-engineer, decompile or disassemble the App;
- remove, alter or obscure any copyright, trademark or other proprietary notices;
- use the App for any unlawful purpose or in any way that could damage or overburden the Service;
- attempt to gain unauthorised access to any part of the Service or its related systems;
- use the App to make clinical, diagnostic or therapeutic decisions for yourself or anyone else.
5. Your account and data
The App does not require you to create an account. Your data — including your profile, wellbeing entries, reminders and any calendar information you allow the App to access — is stored locally on your device. You are responsible for keeping your device secure and for backing up any data you wish to preserve. See our Privacy Policy for how we handle personal data.
6. Subscription — Unburn Pro
6.1 What you get
Unburn offers a paid subscription called Unburn Pro, which unlocks the App’s full feature set including extended score history, PSS-10 monthly assessment, adaptive scheduling, priority support and any additional features we add to the Pro tier from time to time.
6.2 Free trial
New subscribers receive a 7-day free trial of Unburn Pro. During the trial you have access to all Pro features. If you do not cancel before the end of the trial, your subscription will automatically convert to a paid monthly subscription and you will be charged the applicable subscription price.
6.3 Price and billing (auto-renewal disclosure)
The following terms apply to Unburn Pro, as required by Apple’s App Store Review Guidelines:
- Publication / service: Unburn Pro subscription to the Unburn App.
- Length of subscription: one (1) month, renewing automatically.
- Free trial: 7 days, offered once per Apple ID. If you cancel during the trial you will not be charged; if you start a paid subscription before the trial ends, the unused portion of the trial is forfeited.
- Price: the price shown in the App Store at the moment of purchase. Illustrative current price: US$4.99 / month (Apple displays the equivalent price in your local currency and inclusive of any local taxes).
- Auto-renewal: your subscription automatically renews at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period.
- How payment is taken: your Apple ID account is charged for the renewal within 24 hours prior to the end of the current period.
- How to cancel: you can manage or cancel your subscription at any time by going to Settings → [your name] → Subscriptions on your Apple device, or via apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period.
- How to change plan: you can upgrade, downgrade or switch cadence through the same Subscriptions screen on your Apple device.
All purchases are made through and processed by Apple. Apple’s standard payment terms and Media Services Terms and Conditions apply. We do not receive your payment card details.
6.4 Cancellation and consumer rights (14-day cooling-off)
Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have a right to cancel most consumer contracts for digital services within 14 days without giving a reason.
However, by starting the free trial or paid subscription and requesting immediate access to Unburn Pro, you expressly agree that (i) the digital service begins to be supplied immediately, and (ii) you acknowledge that you will lose your right to cancel under the 14-day cooling-off period once the service has begun and you have used it. Where you have started using Pro features but have not consumed the full period, we will still consider refund requests under Section 6.5 below.
6.5 Refunds
Because subscriptions are billed by Apple, refund requests are handled by Apple under Apple’s refund policy. To request a refund, visit reportaproblem.apple.com or contact Apple Support directly.
Nothing in these Terms affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 in the event that a digital service is not of satisfactory quality, not fit for purpose, or does not match its description.
6.6 Changes to price or plan
We may change the price of Unburn Pro from time to time. Where a change affects your renewal price, Apple will notify you in advance and, where required by Apple’s rules or applicable law, request your affirmative consent to continue at the new price. If you do not consent, your subscription will not renew.
7. Intellectual property
The Service, including all software, content, designs, logos, trademarks and the Unburn name, is owned by Mohammad Yaqub Abdul Hafiz (trading as Hash Solution) or by his licensors, and is protected by Indian, UK and international copyright, trademark and other intellectual-property laws. Except for the limited licence granted in Section 4, we grant you no rights in respect of our intellectual property.
You retain full ownership of the wellbeing data you enter into the App. As explained in our Privacy Policy, that data is stored on your device and is not transmitted to us.
8. Acceptable use
You agree not to use the Service in a way that:
- breaks any applicable law or regulation;
- infringes anyone else’s rights;
- attempts to interfere with, disrupt or gain unauthorised access to the Service;
- attempts to reproduce or scrape any part of the Service;
- uses the Service to make clinical, diagnostic or therapeutic decisions.
We may suspend or terminate your access to the Service, without liability, if we reasonably believe you have breached this Section 8.
9. Disclaimers
Except as expressly required by UK consumer law, the Service is provided “as is” and “as available”. We do not warrant that the Service will be uninterrupted, error-free, secure against every threat, or that any wellbeing score, reminder or suggestion will produce a particular outcome.
The Service is provided for informational and wellbeing purposes only. It is not medical advice and must not be relied on as such. If you are experiencing a mental-health crisis or medical emergency, contact your GP, NHS 111, the Samaritans on 116 123, or 999 for emergencies.
10. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or breach of your statutory rights as a consumer under the Consumer Rights Act 2015.
Subject to that, and to the maximum extent permitted by law:
- we are not liable for any loss or damage that is not a foreseeable result of our breaking these Terms;
- we are not liable for business losses (loss of profits, business interruption or loss of business opportunity) — the Service is intended for personal, non-commercial use;
- our total aggregate liability to you for any claim arising out of or in connection with these Terms or the Service is limited to the greater of (a) the amount you have paid Unburn Pro subscription fees in the 12 months preceding the claim, and (b) £50.
11. Termination
You may stop using the Service at any time. If you wish to end a subscription, follow the cancellation steps in Section 6.3.
We may suspend or terminate your access to the Service if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Service. If we terminate a paid subscription for a reason other than your material breach, we will refund the pro-rata portion of any pre-paid fees for the unused period.
12. Third-party terms
These Terms are between you and Unburn only. Apple is not a party to these Terms, but as a licensee of the App via the Apple App Store, you additionally acknowledge and agree that:
- Apple is not responsible for the App or the Service, and has no obligation to provide any maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple, who will refund the App’s purchase price to you (which for a free App is nil);
- Apple is not responsible for addressing any of your claims relating to the App;
- Apple is a third-party beneficiary of these Terms and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Effective” date above and, where the change is material, notify you inside the App. Your continued use of the Service after the change takes effect constitutes your acceptance of the updated Terms.
14. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by and construed in accordance with the laws of England and Wales. You and we both agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim, except that:
- if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your home nation;
- if you are a consumer resident outside the United Kingdom, nothing in these Terms deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and you may bring proceedings in the competent courts of that country to the extent required by those laws.
Choosing the law of England and Wales does not affect our obligations, or your rights, under India’s Digital Personal Data Protection Act, 2023, which continues to apply to our processing activities as an Indian data fiduciary — see our Privacy Policy.
15. Miscellaneous
- Assignment: we may assign or transfer these Terms to a successor or affiliate; you may not.
- Severability: if any provision of these Terms is found unenforceable, the remainder will continue in effect.
- No waiver: our failure to enforce any right does not waive it.
- Entire agreement: together with our Privacy Policy, Cookies notice and Wellbeing disclaimer, these Terms are the entire agreement between you and us regarding the Service.
